1. APPLICATION AND PARTIES

This Comprehensive Disclaimer, Waiver, and Limitation of Liability (“Disclaimer”) is issued by Inkhari LLC, a limited liability company organized under the laws of the Commonwealth of Virginia (“Inkhari,” “we,” “us,” “our,” or “Company”).

This Disclaimer governs and applies to all interactions, without exception, between you (“Client,” “Customer,” “Participant,” or “you”) and Inkhari LLC, including but not limited to:

  • Accessing and browsing the website https://www.inkhari.com and all associated content (the “Website”).

  • Purchasing any physical product, including handcrafted jewelry and accessories.

  • Booking, participating in, or receiving any service, including but not limited to:

    • 1:1 Feminine Healing Sessions (remote, via Zoom, recorded)

    • 1:1 Shamanic or Energy Healing Sessions (remote, via Zoom, not recorded)

    • Tarot, Oracle, or Intuitive Card Readings (delivered via audio recording or other digital format)

    • Any other spiritual, intuitive, divinatory, energetic, ceremonial, personal development sessions, workshops, circles, courses, retreats, in-person or online group sessions, or digital content.

(Collectively, the “Offerings”).

2. NATURE OF OFFERINGS: FOR PERSONAL EXPLORATION ONLY

2.1 Fundamental Purpose. All Offerings, including Services and any guidance provided, are offered exclusively for the purposes of entertainment, personal insight, spiritual exploration, self-reflection, creative inspiration, and general intuitive guidance. They are subjective artistic and spiritual practices.

2.2 NOT PROFESSIONAL ADVICE OR SERVICES. YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT UNDER NO CIRCUMSTANCES ARE INKHARI’S OFFERINGS TO BE CONSTRUED AS, RELIED UPON, OR A SUBSTITUTE FOR:

  • Medical or Healthcare Services: Including diagnosis, treatment, cure, prevention, or management of any physical, mental, or psychological condition, disease, or illness. This includes but is not limited to psychiatry, psychology, psychotherapy, counseling, trauma therapy, somatic therapy, or any clinical therapeutic modality.

  • Professional Advisory Services: Including legal, financial, investment, tax, business, career, or estate planning advice.

  • Formal Religious or Pastoral Ministry: Including spiritual direction (in a formal clerical context), exorcism, or ordained religious practice.

  • Guaranteed Outcomes: Including fortune-telling, guaranteed predictions, assured energetic healings, or promised manifestations.

2.3 No Professional Licensure. Inkhari LLC and its members, managers, or facilitators are not licensed physicians, psychologists, psychiatrists, therapists, counselors, social workers, attorneys, accountants, financial planners, or ordained members of the clergy. No client-practitioner relationship of a clinical, therapeutic, or professional advisory nature is established through your participation.

3. ABSENCE OF GUARANTEES AND WARRANTIES

3.1 No Express or Implied Warranties. Inkhari LLC makes no representations, warranties, or guarantees of any kind, express or implied, regarding any Offering. This includes, without limitation, warranties of merchantability, fitness for a particular purpose, title, non-infringement, or any guarantee of specific results, outcomes, benefits, healings, transformations, or emotional states.

3.2 Subjective Experience. Any testimonials, descriptions of potential experiences, or statements made on the Website, in marketing materials, or during sessions are illustrative anecdotes of subjective personal experiences. They are not guarantees of what you will experience. Individual responses vary dramatically based on personal belief, psychological state, interpretation, and circumstance.

4. ASSUMPTION OF RISK & POTENTIAL RESPONSES

4.1 Voluntary Assumption of Risk. You understand and voluntarily assume all risks, known and unknown, foreseeable and unforeseeable, associated with your participation in any Offering.

4.2 Possible Intense Responses. Engagement with spiritual or introspective content may, in some individuals, trigger or bring to the surface:

  • Strong emotional reactions or releases.

  • Temporary feelings of discomfort, anxiety, or confusion.

  • Resurfacing of memories or past traumatic experiences.

  • Physical sensations (e.g., fatigue, tingling).

  • Vivid dreams or shifts in perception.

4.3 Your Sole Responsibility. You are solely and exclusively responsible for your own physical, mental, emotional, and spiritual well-being during and after any session. You agree to monitor your own state and to seek appropriate independent professional support (e.g., from a licensed therapist or physician) if you experience any distress.

5. RELEASE, WAIVER, AND COVENANT NOT TO SUE

In consideration for being permitted to participate in the Offerings, you hereby:

  • RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE Inkhari LLC, its members, managers, employees, agents, and affiliates (the “Released Parties”);

  • From any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, illness, injury (including emotional or psychological distress), or death, that may be sustained by you or to any property belonging to you;

  • Arising from or in any way connected to your participation in the Offerings, whether caused by the negligence of the Released Parties or otherwise (to the extent such release is enforceable under applicable law).

6. LIMITATION OF LIABILITY

6.1 Exclusion of Damages. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE RELEASED PARTIES BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, OR FOR PERSONAL INJURY (PHYSICAL OR EMOTIONAL), ARISING OUT OF OR RELATING TO THESE OFFERINGS.

6.2 Cap on Liability. IN NO EVENT SHALL THE AGGREGATE LIABILITY OF THE RELEASED PARTIES FOR ALL CLAIMS RELATING TO A SPECIFIC OFFERING EXCEED THE GREATER OF (A) THE AMOUNT YOU ACTUALLY PAID TO INKHARI LLC FOR THAT SPECIFIC OFFERING IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY, OR (B) ONE HUNDRED DOLLARS (USD $100.00).

7. INTELLECTUAL PROPERTY & PERSONAL USE LICENSE

7.1 Ownership. All session recordings, digital deliverables, and content provided are the intellectual property of Inkhari LLC.

7.2 Limited License. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use such materials for your personal, non-commercial use only.

7.3 Strict Prohibitions. You are strictly prohibited from copying, reproducing, distributing, modifying, creating derivative works from, publicly performing, broadcasting, transmitting, publishing, selling, or exploiting any portion of the materials for any other purpose without our prior written consent.

8. PROFESSIONAL CARE ACKNOWLEDGMENT

You affirm that you have been advised and understand that Inkhari LLC’s Offerings are not a substitute for professional medical, psychological, legal, or financial advice or care. You agree not to disregard, delay, or avoid professional diagnosis or treatment based on any information, feeling, or insight gained from an Inkhari Offering. If you are in crisis, you agree to contact appropriate emergency services immediately.

9. GENERAL PROVISIONS

  • Severability. If any provision of this Disclaimer is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

  • Governing Law. This Disclaimer shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law principles.

  • Entire Agreement. This Disclaimer, along with the Terms and Conditions and Privacy Policy, constitutes the entire agreement between you and Inkhari LLC regarding the subject matter herein and supersedes all prior communications.

10. YOUR DECLARATION OF UNDERSTANDING

By booking, purchasing, or participating in any Offering, you digitally sign and declare that:

  • You have read this Disclaimer in its entirety.

  • You fully understand its contents and the legal rights you are waiving.

  • You are participating freely, voluntarily, and without inducement.

  • You are at least 18 years of age and have the legal capacity to enter into this agreement.

IF YOU DO NOT UNDERSTAND OR UNCONDITIONALLY AGREE TO ALL TERMS OF THIS DISCLAIMER, YOU MUST IMMEDIATELY CEASE ALL USE OF THE WEBSITE AND NOT PURCHASE OR PARTICIPATE IN ANY OFFERING.
